Can you sell a phone that’s still on contract?
In almost every case, yes. A UK pay monthly deal is a purchase paid in instalments, not a rental, so the handset belongs to you and you are free to sell it. What carries on is the debt, not a claim on the phone. Your provider is owed the remaining device payments whether the phone is in your pocket or in someone else’s.
Selling it is also perfectly legal. No UK network can stop you, and none of them will ask what happened to the handset as long as the direct debit keeps going out.
Your airtime plan is a separate matter. On EE, O2, Vodafone, Three, giffgaff and Tesco Mobile, the minutes and data sit on a different contract from the handset, so selling the phone leaves your SIM, your number and your monthly airtime bill exactly as they were. Put the SIM in another handset and nothing changes.
There is one deal type where the answer is no. If you lease your phone, you never owned it and you have to hand it back at the end of the term. Check your paperwork for the words “lease” or “hire”. If they appear, do not sell.
Check these five things with your network first
Most people can sell without a single phone call. The exceptions are worth ten minutes of checking, because each one has a real cost attached.
- Is it finance or a lease? Finance means you own the phone and owe money. A lease means the phone belongs to the provider and has to go back.
- Are you on an early-upgrade scheme that wants the handset back? O2 Switch Up, Sky Mobile Swap and Tesco Mobile’s older Anytime Upgrade all give you something in exchange for returning the old phone. On O2 Switch Up specifically, not posting the phone back means you keep paying its device plan alongside the new one.
- Is the contract in your name? If a parent, partner or employer took it out, the handset is legally theirs. Business contracts almost always belong to the company.
- Are you still inside the returns window? Most networks give 14 days to change your mind.
- Is there an open insurance or warranty claim on it? A replacement handset usually has conditions attached, including sending the original back.
If none of those apply to you, and for most sellers none of them will, you are clear to sell.

Check your last bill if you are not sure which of these you are on. Two direct debits, or two separate lines on the bill, means the handset and the airtime are split.
Ask your provider for a settlement figure
Before you sell, find out what it would cost to clear the handset today. That number is your settlement figure, and your provider is required to give it to you under the Consumer Credit Act. On most networks it sits in your account app without you having to phone anyone.
Three questions worth asking while you have them:
- What is the settlement figure on the handset today, separate from the airtime?
- Does my monthly bill drop once the device plan is clear? On O2 it drops automatically. On several other networks you keep paying the same amount until the term ends unless you ask.
- Is there anything on this account that requires the handset to be returned?
Then compare that figure with your vendi quote. If the quote is higher, the sale clears the finance and you keep the difference. If it is lower, you can still sell and keep paying the remaining months as normal.
What happens if you stop paying
Selling the phone is safe. Selling the phone and then stopping the payments is not.
The handset gets blocked on every UK network, not just yours. Networks share a central blacklist database, so an IMEI barred by one provider stops working on all of them. That includes giffgaff, Tesco Mobile and Sky, because they run on the big four’s infrastructure. Unlocking the phone does not help, and neither does a new SIM.
The debt follows you, and it lands on your credit file. A device plan is a regulated credit agreement. Miss payments and your provider records a default with the credit reference agencies. That default stays on your file for six years from the date it was registered, whether or not you eventually pay it off. From there the debt can go to a collection agency, and in the worst case a CCJ.
It makes the next phone harder to get. Every pay monthly contract runs a credit check, and missed payments, defaults and CCJs are exactly what providers look for. It counts against credit cards, loans and mortgage applications too.
None of this happens to people who keep paying.
When to sell for the most money
A phone loses value fastest in the weeks after its replacement is announced, not steadily across the year. Sell while yours is still the current generation and you keep that value.
- iPhone. Apple announces in September, every year.
- Samsung Galaxy S. Unpacked lands in January or February.
- Google Pixel. Second half of the year, usually August.
Networks work to the same calendar, which is what makes the timing useful rather than just interesting. In the weeks before a launch they cut the price of the outgoing model and push their sharpest upgrade offers to clear stock. That is the same window in which your current phone is worth the most. Sell first, then take the deal.
Say you are on EE and you plan to upgrade in the autumn. Getting your quote in August, before Apple’s September event, is worth more than getting it in October. Same phone, same condition, different week.

Before you send it
- Back up, then factory reset. Everything on the phone goes.
- Turn off Activation Lock or Find My Device. The single most common reason a device cannot be processed.
- Take the SIM out. Keep it if you are staying on the same number and plan.
- Check the IMEI is clear with our free IMEI checker.
- Keep paying your device plan until it is settled, or clear it with the proceeds.

FAQs About your contract
Can I sell my phone if I still owe money on it?
Yes. The outstanding balance is a debt between you and your provider, not a claim on the handset. Sell it and keep paying monthly, or use the money to settle in one go. The thing to avoid is stopping payment.
Is it illegal to sell a phone that’s on contract?
No. You own the handset, so selling it is legal and no UK network can prevent it. What would be a problem is selling a phone that belongs to someone else, or one you are leasing rather than buying.
Does selling my phone cancel my contract?
No, and this catches people out. The handset leaves, the agreement stays. If you want both to stop, settle the device plan and give notice on the airtime separately.
Will my network know I’ve sold my phone?
Networks do not track which handset your SIM sits in for billing purposes, and none of them will ask. The exception is an upgrade scheme that expects the old handset back.
What happens if I sell my phone and stop paying?
Three things. The network can blacklist the IMEI, which stops the phone working on every UK network including giffgaff, Tesco Mobile and Sky. Your provider records a default that stays on your credit file for six years. And that default can mean being refused instalments on your next phone.
Does selling my phone affect my credit score?
Selling it has no effect at all. Missing the payments afterwards does. The device plan is a regulated credit agreement, so arrears show up like any loan.
How much is my contract phone worth?
That depends on the model, storage, condition and battery health, not on your contract or how much you still owe.
When exactly do I get paid?
The same day your device arrives, by Faster Payments bank transfer, as long as it reaches us before 2pm and passes verification. That window gives the team time to check and approve the device and process the payment. Anything arriving after 2pm is paid the next working day.
How do I find out how much I still owe?
Ask for a settlement figure on the handset. Make sure the number covers the device only, not the airtime.
How do I buy out my phone contract?
Pay the settlement figure and the device side of your bill stops. Your airtime plan is separate and needs cancelling on its own terms, usually with 30 days’ notice.
What if my phone is cracked or damaged?
We still buy it. Cosmetic damage moves the device into a lower grade rather than ruling it out, so a cracked screen means a smaller quote, not no quote. What we cannot take is a handset with non-genuine parts fitted, a counterfeit device, one reported lost or stolen, or one still locked to an account.
Do I need the original box and charger?
No. Original packaging and accessories add value, so include them if you still have them. The handset on its own is fine.
Can I sell a phone that’s blacklisted?
No. A blacklisted handset cannot connect to any UK network, so it has almost no resale value and vendi cannot process it. Run the IMEI checker first.
What if the contract is in someone else’s name?
Then the handset is theirs, not yours, even if you have always been the one using it. Get their agreement before you sell.
Can I sell a work phone?
Only if you bought it yourself. A handset on a business contract belongs to the company even when you are the only person who has ever used it.
